Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 214 of 2022 dated 24.06.2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

The main submissions advanced by learned counsel for petitioner are that the petitioner earlier preferred Cr. Misc. No. 52898 of 2022 for the relief of regular bail which was rejected by this Court with a liberty to the petitioner to renew his bail prayer after the framing of charge and thereafter the charge has been framed upon the petitioner and he has again come before this Court for the same relief. Further submissions are that the petitioner is not named in the FIR and he has been languishing

Patna High Court CR. MISC. No.28790 of 2023(2) dt.03-05-2023 2/2 in jail since 26.06.2022 and he was not put on Test Identification Parade and the alleged CCTV footage was not examined scientifically by the police and against the petitioner there is criminal antecedent of one case in which he is on bail. 4.

Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the above submissions and mainly the facts that the trial of the petitioner has started and the same is at initial stage and the petitioner has been languishing in jail since 26.06.2022, in my opinion, this second prayer for bail by the petitioner is acceptable. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Sangrampur P.S. Case No. 214 of 2022.
