Application on behalf of the petitioner No.1 stands dismissed as withdrawn.
Heard learned counsel for the petitioners and learned APP for the State.
The petitioner Nos.2 and 3 are apprehending their arrest in a case registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioners assaulted the informant's wife and his daughter by means of lathi and rod. When the informant came to save them, he was also assaulted by them with rod on his head.
Patna High Court Cr.Misc. No.38386 of 2016 (3) dt.13-12-2016 2/2 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The nature of injury is said to be simple. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner Nos.2 and 3, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. case No.37 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
