JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-07-2026 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant/Opposite Party No. 2.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 96 and 137(2) of the B.N.S. and Section 8 of the POCSO Act.
3. As per prosecution case, it is alleged that this petitioner, along with other co-accused persons, kidnapped minor daughter of informant and took her away to an undisclosed location. During investigation, the victim was recovered and in her statement recorded under Section 183 of
Patna High Court CR. MISC. No.30162 of 2026(3) dt.01-07-2026 2/2 the B.N.S.S., she has supported the prosecution case. The learned trial court has assessed age of victim as 15 years. Petitioner has got one criminal antecedent.
4. Considering the facts and circumstances of the case, specific and direct nature of accusation, statement of the victim recorded under Section 183 of the B.N.S.S., fact that victim is a minor and criminal antecedent of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
