JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2018 The petitioner is apprehending his arrest in connection with Shahpur P.S. Case No. 06 of 2018, registered for offences punishable under Section 25 (1-b)(A), 26 of the Arms Act. Allegation against the petitioner is of recovery of one country made pistol from his house.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the house from where the recovery was made does not belong to petitioner rather the same belongs to Bijendra Rai.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of accusation as well as the criminal antecedent of the petitioner, I am not inclined to grant the

Patna High Court Cr.Misc. No.27466 of 2018 (2) dt.10-05-2018 2/2 privilege of anticipatory bail to the petitioner. This application is accordingly dismissed.

However, the petitioner, if so desire, may surrender before the court below and make prayer for regular bail, which will be considered on the merit of the case.
