Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 409, 420 and 120 (B) of the Indian Penal Code.
It has been submitted on behalf of the petitioner that there is as many as sixteen cases have been lodged against the petitioner in connection with the same offence, out of which in all other cases except present one, he has been enlarged on bail and by mistake, he could not know about the present case. It has further been submitted that the petitioner has already compromised with the complainant, outside the Court and hence, the petitioner may be granted the privilege of bail.

Considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, in connection with Complaint Case C.A. No. 776 of 2005, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
