This application, for grant of anticipatory bail, arises out of Complaint Case No. 362 of 2017, disclosing offences under Sections 354, 452, 379, 323 and 504 of the Indian Penal Code and 3/4 of the Dyne Act.
Learned counsel for the petitioners has submitted that there is general and omnibus allegation against these petitioners and no specific overt act is attributed to them. In fact, this case is a counter blast of the Bounsi P.S. Case No. 51 of 2017, which is at annexure-2. As a matter of fact, there is land
Patna High Court Cr.Misc. No.30982 of 2018 (2) dt.05-06-2018 dispute between the parties and on account of that the petitioners have falsely been made accused in this case. The petitioners are of clean antecedents. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-3rd, Banka, in connection with Complaint Case No. 362 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
