JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioners seek regular bail in connection with Excise Case No. 501/2019 arising out of Ara Muffasil P.S. Case No. 84/19, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of Excise Act.

Allegation is of recovery of 60 litres of mahua from possession of the petitioner and allegation is of recovery of 75 litres of mahua from petitioner. no. 2.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and in fact nothing has been recovered and they have no criminal antecedent and have been in judicial custody since 12.03.2019.

Patna High Court CR. MISC. No.30501 of 2019(2) dt.23-05-2019 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge cum Special Judge, Excise, Bhojpur at Ara, in connection with Excise Case No. 501/2019 arising out of Ara Muffasil P.S. Case No. 84/19, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
