JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-01-2018 It appears that earlier an anticipatory bail application filed by the petitioner arising out of Jamui (Adarsh) P.S. Case No. 175 of 2017 was permitted to be withdrawn by an order dated 02.11.2017 passed in Cr. Misc. No. 38228 of 2017.

Without going into the question of maintainability of the present second anticipatory bail application, I am not inclined to entertain this application considering all the facts and circumstances of the case and materials available on record.

It is, however, indicated that the present order shall not prejudice the petitioner's case for grant of regular bail, if he appears and seeks such privilege before the Court below.

This application is dismissed.
