The petitioners are apprehending their arrest in a case registered under Sections 498A and 302/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
Allegation against the accused persons is of committing murder of female child of the informant by strangulating her neck.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner No.1 is distant relative, petitioner
Patna High Court Cr.Misc. No.49558 of 2017(2) dt.17-10-2017 2/2 No.2 is grand mother, petitioner Nos.3 and 4 are uncle and petitioner No.5 is grand father of the deceased. They are separate in mess and property from the husband of the informant. The matter has already been compromised between the parties vide Annexure-3 to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Madhuban P.S. case No.307 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
