JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-07-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners seek bail in a case registered for offence under Sections 406, 420, 408, 409, 34 of the Indian Penal Code.
3. As per F.I.R., the allegation against petitioners is that they alongwith other co-accused persons, who were employees of the B.D.Sinha Janta College, Akauna, misappropriated Rs. 48,67,500/-, which was collected as enrollment fees from the students, but the accused persons did

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case merely because they were employees of the said college. Petitioners have no concern with the collected money of the college. As a matter of fact, it was the informant and others, who embezzled the fund of the college, for which, the on 23.10.2019, informant himself was removed by the inquiry committee and later, on 17.08.2020, he was terminated from the post of Principal, but again on 11.03.2022, he was appointed on the same post. It is the informant, who defalcated Rs. 18 lakhs of the college, as such; Goh P.S. Case No. 149 of 2020 under Section 409 of the I.P.C. was lodged against him. Learned counsel further submits that co-accused Sudhir Kumar Singh has been granted bail by this Court, vide order dated 09.08.2024 passed in Cr.Misc. No. 29482 of 2024. Petitioners have got clean antecedent and are in custody since 21.03.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing

No.29659 of 2025(3) dt.18-07-2025 3/3 bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Daudnagar, District Aurangabad in connection with Goh P.S.
