====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 414, 120(B) and 34 of the Indian Penal Code and Section 25(1-b) a, 26 and 35 of the Arms Act. The informant alleges that two accused persons were apprehended and from their possession arms along with other articles as detailed in the FIR was recovered and they disclosed the name of Vikky Tiwari who had provided the arms and forged license at the instance of his father i.e. the petitioner. Learned senior counsel submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that

No.28588 of 2022(2) dt.15-11-2022 2/2 admittedly from perusal of the allegation it would manifest that he was not present at the place of occurrence and his name was transpired in the confessional statement of co-accused in police custody which does not have any evidentiary value. Learned counsel next submits that admittedly he is a person with clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dumraon P.S. Case No. 119 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
