For the Petitioner/s : Mr. Arvind Kumar Verma For the Respondent/s : Mr. D.K.Prasad, GP 7 =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 17-03-2016 Let the petitioner move the managing committee, which have to take a call on the issue of appointment of a Principal. However, it is made clear that no person contrary to the age of superannuation fixed by the State can be continued on any post, if he reaches the age of superannuation, which in this case is said to be 60 years. If the private respondent continues to function as such beyond the said age, obviously the managing committee is committing an illegality and they run the risk being removed or replaced, if the occasion arises.
Writ is disposed of with the above observation. (Ajay Kumar Tripathi, J) sk U
