====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sahebganj P.S. Case No. 388 of 2018, instituted for the offence under Section(s) 399, 402, 414 of the Indian Penal Code, Sections 25(1-B)a, 26 and 35 of Arms Act.

It is alleged in the written report that on getting confidential information that six persons assembled to commit crime, the informant along with other Police personnel reached the place of occurrence. On seeing the Police party, three persons sitting on the Motorcycle fled away. Two persons sitting on Passion Pro Motorcycle were also trying to run away, but they were apprehended. Patna High Court CR. MISC. No.27731 of 2019(2) dt.29-04-2019 2/2 Kumar Mahto (petitioner) and Abhimanyu Kumar. On search, one loaded country made pistol and one live cartridge have been recovered from possession of the petitioner. Counsel for the petitioner submits that co-accused Abhimanyu Kumar has already been granted bail by coordinate Bench of this Court vide order dated 9.4.2019 passed in Cr. Misc. 22649 of 2019.

Petitioner is in custody since 19.10.2018.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, West Muzaffarpur, in connection with Sahebganj P.S. Case No. 388 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
