The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,149,307,448,341,323,324,325,504 and 506/34 of the IPC and Sections 3 and 4 of the Prevention of Witch (daain) Practices Act, 1999.

The prosecution case is that the petitioner assaulted with Farsa on the head of the informant's daughter Arti, causing cut injury. Co accused Shakuntala assaulted with iron rod on the shoulder of the informant causing fracture injury. It is further alleged that rest of the accused assaulted others with intention to kill when Anil Kumar and Deepak Kumar came to pacify, coaccused Anand Kumar, Laxman Bhagat and Nitish Kumar and others assaulted, causing head injury.

No.59923 of 2017(2) dt.12-12-2017 2/2 It is submitted by learned counsel for the petitioner that the injury of Arti has been found to be superficial simple in nature though sharp cut injury has been found on the middle of the head. The petitioner side lodged Madhuban P.S. Case No. 177 of 2017 making accusation under sections 341,323,324,307,504 and 506/34 of the IPC when the petitioner received grievous injury at the hands of the informant side. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that the informant has received simple injury, whereas the petitioner has received grievous injury having no criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari in connection with Madhuban P.S. Case No.176 of 2017.
