The petitioner apprehends his arrest in a case registered for the offence under Section 7 of the E.C.Act. As per the prosecution case, four bags of food-grains each of 50 kg. and 30 empty bags have been recovered from a pick-up van as also two bags each of rice and wheat were recovered near the pick-up van and it is alleged that the same was being transported for black-marketing.

It is submitted on behalf of petitioner that petitioner is neither PDS dealer nor agent and has been made accused only due to the fact that petitioner is owner of the pick-up van. It is next submitted that without knowledge or consent of petitioner, his vehicle was being used for transporting the seized articles, whereas, petitioner has got no concern with the seized articles. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.27992 of 2022(2) dt.22-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Jaynagar P.S. Case No. 56 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
