1. Heard learned Senior counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Aurangabad Muffasil P.S. Case no. 494 of 2024 registered under sections 126(2), 115(2), 352, 351(2), 74, 324(4), 333, 109(1), 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that while she along with her husband were at home, Satyendra Yadav and the members of his family including the petitioners herein along with 20-25 persons came variously armed and

It is further stated that the petitioner nos. 1 and 2 also took away the gold chain of the informant. The informant further states that Satyendra Yadav assaulted Vikram Kumar Sinha on his head. Further the wife and daughter of Satyendra Yadav also assaulted Vikram Kumar Sinha on the head.
4. Learned Senior counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case. There is case and counter case between the parties. The main allegation is against Satyendra Yadav and not the petitioners herein. Even the injury on the head of Vikram Kumar Sinha, which finds mention in paragraph no.64 of the case diary and which has been referred to in the order of the learned trial Court, is mainly attributable to Satyendra Yadav, though there is general and omnibus allegations against the petitioner nos.1 and 2 also. The petitioners undertake to cooperate in the investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioners in the F.I.R., there being case and counter case
Patna High Court CR. MISC. No.28220 of 2025(2) dt.03-06-2025 3/3 between the parties and the main allegation of assault being on Satyendra Yadav, it is directed that all the four petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Aurangabad Muffasil P.S. Case no. 494 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad.
