JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-05-2019 Heard the learned counsel for the petitioner and the learned APP appearing on behalf of the State. The present case is a second attempt on behalf of the petitioner for grant of regular bail in connection with Begusarai Town (Ratanpur) P.S. Case No. 669 of 2014, registered for the offences punishable under Sections 324, 307, 504/34 of the Indian Penal Code and Section 27 of Arms Act. In the present case, there is specific allegation of the petitioner having fired on the informant resulting in injuries to the informant and it was good fortune of the petitioner that the gun shot did not hit on the head of the informant otherwise the same could have been fatal.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.28046 of 2019(2) dt.17-05-2019 2/2 that the petitioner is languishing in custody since 01.09.2016, hence, he is entitled for grant of regular bail since the trial is not progressing.

Having considered the gravity of the offence alleged to have been committed by the petitioner herein as also the fact that there is no change in the circumstances, this Court does not find any occasion to entertain the present petition, hence, the same is dismissed.
