The petitioners apprehend arrest in connection with Complaint Case No. 467C of 2009 arising out of Parvatta (Maraiya O.P.) P.S. Case No. 245 of 2007 registered under Section 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Patna High Court CR. MISC. No.28618 of 2023(2) dt.14-07-2023 2/2 Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. From perusal of Annexure5, it appears that earlier petitioner no. 1 had lodged a case against the informant's son and others for the same offence. Further he submits that in the instance case, final form (Annexure-2) has already been submitted. Petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of C.J.M., Khagaria in connection with Complaint Case No. 467C of 2009 arising out of Parvatta Maraiya P.S. Case No. 245 of 2007, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
