JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Baikunthpur P.S. Case No. 164 of 2020 for the offences under Sections 272 and 273/34 of the Indian Penal Code and Sections 30(a) of Bihar Prohibition and Excise Act, 2016 and Amended Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 15.06.2020. In the instant total 105 litres of country made liquor was seized from his possession.

Considering the fact that the country made liquor was seized from possession of the petitioner, as alleged by the

Patna High Court CR. MISC. No.24770 of 2020(2) dt.23-09-2020 2/2 prosecution, the Court is not inclined to grant bail to the petitioner for the present. The prayer for bail is rejected for the present.
