The Petitioner apprehends his arrest in Kudhani P.S. Case No.13 of 2015 instituted for the offence under Section(s) 364-A Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Kaimur at Bhabhua.

It appears from the order of the learned Sessions Judge that processes under Section 82-83 Cr. P.C. have been issued and the petitioner has been declared as proclaimed offender.

The case is of the year 2005 and the petitioner is evading his arrest since then.

In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Patna High Court Cr.Misc. No.702 of 2017 (4) dt.16-02-2017 2/2 Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order and also by taking into consideration the fact that other accused, who have faced trial, have been acquitted.
