The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a)/36 of Bihar Prohibition and Excise Act.

Total 878.4 liters of Nepali Saufi wine has been recovered from a pick-up van.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the vehicle in question. Petitioner has got clean antecedent. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Case No. 565 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
