2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 504, 323, 324, 325, 326 and 307 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner assaulted by means of 'farsa' on the leg of the informant due to which he received cut injury. It is alleged that at the time of the occurrence, altogether 12 accused persons were there and the main thrust of allegation is against Shiv Kumar Yadav, who was armed with 'talwar'.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that

It is further submitted that co-accused persons, namely, Mukesh Kumar and Shiv Kumar Yadav have been granted bail by this Court vide order dated 05.09.2024 and 13.12.2024 passed in Cr. Misc. Nos. 61556 of 2024 and 81863 of 2024 by a co-ordinate Bench of this Court. Moreover, the petitioner is languishing in judicial custody since 30.12.2024 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mohanpur P.S. Case No. 95 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Sherghati Gaya.
