JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 20-07-2026 Heard learned counsel for the petitioner, learned APP for the State and perused the case diary. Despite valid service of notice, none appeared on behalf of Opposite Party No. 2.

2. The petitioner seeks bail in connection with Akbarnagar P.S. Case No. 41 of 2025, instituted for the offences punishable under Sections 96 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that the petitioner and other accused persons allegedly abducted the informant's minor daughter with the intention of marrying her and misbehaved with the informant when he searched for her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case under Sectons 96 of the Bharatiya Nyaya Sanhita, 2023 and Section 4/6 of POCSO Act. Learned counsel for the petitioner also submits that the petitioner and the victim were in love and there was no inducement by the petitioner rather the victim herself came to the petitioner. It is next submitted that the victim has not supported the prosecution case in her statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The victim has also refused for her medical examination. It is further submitted that there is no any ingredient of Section 96 of BNS in this case. The petitioner is in custody since 17.10.2025 and has got no criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two
