====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 14-07-2023 Heard Mr. Binit Kumar, learned counsel appearing on behalf of the petitioner and Mr. Sucheta Yadav, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Harnaut P.S. Case No. 172 of 2021 registered for the offence punishable under Sections 392 and 395 of the Indian Penal Code.

3. It is alleged that Rs.80000/- cash, a torch, three mobile phones and the motorcycle of the informant bearing Registration No. BR 21 S 4157 was looted from the house of the petitioner. In course of investigation, co-accused Bablu Yadav was apprehended who disclosed the name of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he is

Patna High Court CR. MISC. No.28710 of 2023(2) dt.14-07-2023 2/2 nowhere connected with co-accused Bablu Yadav, even though he is his co-villager. Petitioner has clean antecedent. No recovery has been made from the house of the petitioner.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 172 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) mantreshwar/- U T
