JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners as well as learned counsel for the informant and the learned counsel for the State. The petitioner prays for anticipatory bail in connection with Yogapatti P.S. Case No. 213 of 2016 registered for the offences punishable under Sections 272 and 273 the Indian Penal Code and Section 47(A) of the Bihar Excise Act.
It has been submitted on behalf of the petitioner that two litres country made liquor was recovered from the conscious possession of the petitioner. Thereafter the informant seized the alleged recovered liquor after preparing the seizure list.
Learned A.P.P. opposes the prayer of bail application. Considering the facts and circumstances of the case and other materials reflected from the record including the impugned order, I am not inclined to extend him the privilege of anticipatory bail. Accordingly the
Patna High Court Cr.Misc. No.45474 of 2016 (2) dt.15-12-2016 2/2 prayer for bail is rejected.
The petitioner may surrender before the court below within a period of three weeks from today and pray for bail, if he does so, the court below shall consider this aspect of the matter that only 2 litres of liquor has been recovered and disposed of his bail application on the same day on its own merit without being prejudiced by the present order.
