The petitioner is apprehending his arrest in connection with Malaypur P.S. Case No. 59 of 2017 for offences punishable under Sections 341, 323, 379 and 307/34 of the Indian Penal Code.

The prosecution case as per the written report of Sandeep Kumar Singh, dated 09.11.2017, submitted to the Station House Officer, Malyapur Police Station, Jamui, is to the effect that on 09.11.2017 at about 05.00 P.M. the petitioner, Raushan Kumar Singh, Ghutur Kumar Singh, Abhijit Kumar Singh and one unknown person came to the shop of the informant, asked for cigarette and match box, but, on demand, did not pay money and made assault to the informant causing head injury.

It is submitted by the learned counsel for the petitioner that the injury has been found superfluous caused by

Patna High Court Cr.Misc. No.23985 of 2018(2) dt.30-04-2018 2/2 hard and blunt substance. The petitioner is the employee of the contractor of Jamui Railway Station and work in the parking stand and used to collect parking money/fee. The statement has been made in paragraph 3 that the petitioner has no criminal antecedent.

The learned Additional Public Prosecutor submits that there is accusation of the petitioner.

Considering the nature of accusation and the injury, the prayer of the petitioner for grant of anticipatory bail is allowed, in the event of surrender/arrest of the petitioner, named above, before the Court below, within four weeks from today in connection with Malaypur P.S. Case No. 59 of 2017 shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
