2. This application has been filed on behalf of the petitioner for setting aside the order dated 19.01.2024 passed by the learned Additional Sessions Judge-II, Saran at Chhapra in Cr. Appeal No. 49 of 2000 arising out of Dighwara P.S. Case No. 58 of 1993/G.R. No. 1619 of 1993/Tr. No. 571 of 2000.

3. It has been submitted by the learned counsel for the petitioner that due to the mistake on the part of the lawyer of the petitioner, proper pairbi was not done and therefore the bail bond of the petitioner was cancelled and warrants have been issued.

4. Learned counsel for the petitioner submits that the petitioner undertakes to appear personally or through his

Patna High Court CR. WJC No.1225 of 2024(2) dt.08-07-2025 2/2 advocate regularly in the pending criminal appeal and further undertakes not to delay the disposal of the criminal appeal.

5. In view of the above and also in the interest of justice, this application is allowed.

6. Accordingly, the order dated 19.01.2024 passed by the learned Additional Sessions Judge-II, Saran at Chhapra in Cr. Appeal No. 49 of 2000 arising out of Dighwara P.S. Case No. 58 of 1993/G.R. No. 1619 of 1993/Tr. No. 571 of 2000 is hereby quashed.

7. The petitioner is directed to appear in the concerned Court below and execute fresh bail bonds of Rs. 5000/- and he will co-operate in the disposal of the appeal.

8. With the aforesaid direction, this application is allowed.
