Learned counsel for the petitioner submits that his father has donated a land to the temple but the land has been encroached by private respondents. On the application of the villagers Encroachment Case No. 01/2013-14 was initiated, however, the same has remained pending till date.

On such submission having been made, this Court, without going into the merit of the cases of the respective parties, would direct the Circle Officer, Sultanganj, Bhagalpur to bring the
