The petitioner seeks anticipatory bail in connection with Bhagalpur Mahila P. S. Case No. 48 of 2017, registered for offences punishable under Sections 341, 323, 376, 504 and 506/34 of the Indian Penal Code.

The allegation against the petitioner is of committing rape upon the informant.

Submission of the learned counsel for the petitioner is that this is fact that there is love affairs between them and they have married now and live together.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances discussed above, this application is disposed of with

Patna High Court Cr.Misc. No.27535 of 2018 (2) dt.10-05-2018 2/2 direction to the petitioner to surrender and make prayer for regular bail and it is made clear that the learned Court should verify the fact that if the petitioner and the victim girl have already married and live together, his bail application shall be disposed of considering the above fact in mind.

This application is accordingly disposed of.
