The petitioner apprehends his arrest in connection with Sitamarhi P.S. Case No. 86 of 2019, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

304.165 liters foreign liquor is said to have been recovered from the Scorpio and four accused persons were apprehended who disclosed the name of the petitioner and one Mukesh Kumar to be purchasers of the said liquor. It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from

He has no concern either with the seized liquor or the place of recovery or any trade of liquor or with the apprehended accused persons. there is nothing on record to indicate the complicity of the petitioner barring disclosure of the apprehended person which has no evidentiary value in the eyes of law. No offence under Excise Act is made out against the petitioner. He has no criminal antecedent.

Learned Spl. P.P. for the State opposed the prayer for bail.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail in the event of his arrest or surrender before the learned Court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J II-cumSpecial Judge Excise Act, Sitamarhi in connection with Sitamarhi P.S. Case No. 86 of 2019, subject to condition as laid down under Section 438 (2) of the Cr.P.C.
