JUSTICE RAVI RANJAN ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 409, 420 and 34 of the Indian Penal Code.

As per the allegation, the petitioner being in-charge of the Government Middle School, Mathapakar along with Daulat Devi, Secretary, Siksha Samiti has misappropriated the government articles kept in the old building of the aforesaid school while a new building was being constructed.

It is contended on behalf of the petitioner that Daulti Devi, Secretary has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 4.11.2015 passed in Cr. Misc. No.32783/2015.

No.5866 of 2015 (5) dt.11-04-2016 2/2 Having regard to the facts and circumstances of the case, let the petitioner, namely, Shiv Ratan Kumar be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Nanpur P.S. Case No.59 of 2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
