2. This is an application for grant of regular bail submitted by the petitioner in connection with Obra P.S. Case No. 81 of 2025 registered for the offence under Sections 137(2) and 96 of the Bharatiya Nyaya Sanhita.

3. According to the case of prosecution, on the date of incident i.e. on 25.02.2025 age of the victim girl was about 14 years allegedly when she was going to school, the present applicant abducted her and taken her with him. Subsequently, when the matter was reported by the informant then both of

Patna High Court CR. MISC. No.26598 of 2025(2) dt.05-05-2025 2/3 them returned back to the village. On the basis of the information given by the informant, the offence has been registered and during course of investigation, the present applicant has been arrested on 02.03.2025.

4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case due to some family dispute with the victim's family. He further submits that bare perusal of the statement of the victim itself shows that she herself left the house and joined the company of petitioner. Therefore, no case of abducting has been prima facie made out. Lastly, he submits that petitioner is in custody since 02.03.2025, having no criminal antecedent. Therefore, on these grounds, it is prayed that he may be granted benefit of regular bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

6. Considering the above submissions made by the counsel for the petitioner, I am of the view that it is a case where the petitioner should be granted benefit of bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
