The petitioner apprehends his arrest in connection with Bodh Gaya (Cherki) P.S. Case no. 399 of 2014, registered under Sections 363 and 366 (A) of the Indian Penal Code. The accusation is that on 19.12.2014, minor daughter of the informant along with Rinki Kumari and Pinki Kumari had gone to the school to appear in the monthly test, but the daughter of the informant did not return in the late evening. When informant made queries from both the said girls, then he come to know that his daughter moved in the way with one boy saying that she is going to Gaya. Further allegation of informant is that on 19.12.2014 in between 8.00 A.M to 12.00 Noon, on several occasions, calls were received from mobile No. 8521899939 on his mobile No. 9801637015.
Patna High Court Cr.Misc. No.43687 of 2016 (2) dt.19-10-2016 2/2 Learned counsel for the petitioner submits that, in fact, the daughter of the informant moved with this petitioner according to her sweet will and performed marriage in a temple at Lakhisarai. The statement of victim, daughter of the informant is recorded under section 164 Cr.P.C. in which she has stated that she moved with the petitioner according to her sweet will and performed marriage with this petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Bodh Gaya (Cheraki) P.S. Case No. 399 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
