A dismissed employee is not entitled to any kind of benefit. If he is not entitled to any benefit then naturally no legal heir can claim any other benefit by way of pension or family pension benefit etc. Other retirement benefit has already been paid to the petitioner as is the stand taken in the counter affidavit.
Annexure-1 is the order of dismissal, which was passed on 21.07.2006 and since the said order still stands, no relief can be granted.
