JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2021 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was refused by this Court vide order dated 4.10.2018, passed in Cr.Mis.No. 52189/2018 with observation to the trial court to expedite the trial.

From perusal of the impugned order dated 3.1.2020 it appears that though cognizance of the offence has already been taken on 25.1.2019, but due to non-production of the accused petitioner, charge has not been framed in Sessions Trial No. 38 of 2018. However, report of the trial court dated 30.9.2020 reflects that the case is pending on the stage of police paper and production of the accused.

In view of the aforesaid development in the case, prayer for bail of the petitioner is refused. Let the trial be expedited and concluded as early as possible.
