JUSTICE PARTHA SARTHY ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Ekma P.S. Case No. 306 of 2019 registered under sections 395 and 397 of the Indian Penal Code.

As per allegation in the FIR, five accused persons entered in the branch of State Bank of India and on the point of the pistol looted Rs. 58,700/- in cash. The informant branch manager stated that one of the accused persons entered into his cabin, assaulted him and he can identify the accused. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of co-accused Abhishek Tiwari made in another

Patna High Court CR. MISC. No.28255 of 2020(3) dt.14-12-2020 2/2 case. The same having been made before the police, has no evidentiary value. It is submitted that the petitioner is in custody since 10.2.2020, he has not been put on T.I. parade and no incriminating article has been recovered from his possession. Charge sheet in the case has been submitted.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration, the petitioner is in custody since 10.2.2020 and has not been put on T.I. parade, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Ekma P.S. Case No. 306 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Chapra.
