Smt. Sharda Kumari (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-04-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Patrakar Nagar P.S. Case No. 390 of 2017, registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code.

Allegedly, the informant supplied bricks at several sites of Soho Group Company and dues of Rs. 21,38,100/- remained and when the informant demanded the said amount from Manager Awadhesh Kumar Singh and both directors Vijay Singh and the petitioner, took one plea or other and when the informant visited the office he was brutally assaulted by the co-accused Awadhesh Kumar Singh and other staffs.

Submission is of false implication, as a matter of fact the informant and his men has assaulted Awadhesh Kumar Singh and

Patna High Court Cr.Misc. No.21081 of 2018(2) dt.30-04-2018 2/2 snatched money for which Patrakar Nagar P.S. Case No. 389 of 2017 has been lodged and after lodging of the said case the informant lodged the present case with false and fabricated allegation. Coaccused Awadhesh Kumar Singh has already been allowed pre-arrest bail vide Cr. Misc. No. 22001 of 2018 by order dated 26.04.2018 by another co-ordinate Bench of this Court and the case of the petitioner is on better footing.

The learned A.P.P. fairly submits that co-accused Awadhesh Kumar Singh has already been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-X-cum- A.C.J.M., Patna, in connection with Patrakar Nagar P.S. Case No. 390 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
