ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.03.2019 in connection with Garhpura P.S. Case No.79 of 2018 registered for the offence under Sections 30(a) and 37(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery of 1.5 litres of foreign liquor, however, the same was not from his conscious possession and there is no eyewitness to the said recovery. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of
