The petitioners, namely, Bishun Thakur, Dharmendra Thakur, Mahesh Thakur and Asha Devi, apprehend their arrest in Majhauliya P.S. Case No. 183/2016 registered under Section 307 and other sections of the Indian Penal Code.

Sunaina Devi, the informant, alleged that the petitioners and others came on the land situated in front of her house and assaulted the informant, her son and grand-son, namely, Ramesh Prasad and Pappu Kumar. It is submitted that there is a counter version. The land was being measured in pursuance of the order of Anchal Adhikari, Majhauliya and some scuffle took place between the parties. For that, from the side of the petitioners,

Patna High Court Cr.Misc. No.41174 of 2016 (2) dt.29-09-2016 2/2 Majhauliya P.S. Case No. 186/16 was registered. The informant Sunaina Devi, her son Ramesh Prasad and grand-son Pappu Kumar got simple injuries.

Considering the facts that there is a case and counter case and the occurrence took place between the parties due to land dispute and the injured got simple injuries, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah in Majhauliya P.S. Case No. 183/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
