18-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, in the present, case, is seeking Anticipatory Bail in connection with Narpatganj P.S. Case No. 285/2017 for the offences under Sections 302/201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is the wife of one Sanjay Mehta and the whole allegation against this petitioner is that she was standing near the place of occurrence as a guard. Learned counsel submits that no overt act or participation in the alleged occurrence has been alleged against this petitioner and a similarly situated accused against whom this was the allegation namely, Kapleshwar Mehta, father of Sanjay
Patna High Court Cr.Misc. No.50724 of 2017 (2) dt.18-10-2017 Mehta has already been granted privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 49344/2017.
Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the nature of allegation particularly that no role has been assigned to this petitioner in the alleged offence and a similarly situated accused has already been granted privilege of anticipatory bail by coordinate Bench of this court, in the event of her arrest/surrender before the court below within a period of six weeks, let the petitioner namely Kavita Devi, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S. Case No. 285/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
