Shri Awadhesh Prasad Singh, learned counsel appearing for the University and Shri Siddharth Shankar Pandey, Learned counsel appearing for the State are present.

The application was filed in the year 2014 and ever since filing of the application none has appeared on behalf of the applicant. When the matter was taken up on 23.5.2017, none had appeared for the applicant, but learned counsel for the University informed this

Patna High Court MJC No.596 of 2014 dt.05-07-2017 2/3 Court that he has not received a copy of the M.J.C. due to which he is unable to file show cause.

Today also when the matter is taken up, none is present for the applicant. A perusal of the order passed by the learned Writ Court on 19.8.2013 in C.W.J.C. No.7056 of 2013 goes to show that the writ petition was disposed of with a direction to the University to examine the claim of the petitioner and all admissible retiral dues were to be paid and the issue decided. Today when the matter is taken up, both the learned counsel for the State and the learned counsel for the University are unable to make any statement as the copies of the contempt application and the documents have not been supplied to them.

Taking note of the situation and the fact that the matter is pending since 2014 and the applicant and his counsel are absent, this application is disposed of with the following directions: In case the petitioner has any grievance still subsisting and in case the claim has not been settled in spite of the order dated 19.8.2013, on the petitioner filing a certified copy of this order along with relevant documents, the University shall take action in the matter in accordance with the order dated 19.8.2013 and communicate the decision to the petitioner if action has already been taken, otherwise it shall be incumbent upon the University to take
