2. The petitioner apprehends arrest in connection with Dariyapur P.S. Case No. 633 of 2022 dated 24.11.2022 registered for the offence punishable under Section 302, 304B, 201/34 of the Indian Penal Code.

3. The prosecution case, in short, is that on 16.11.2022 the informant came to know that his daughter was killed by her in-laws family.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is the husband of the deceased (wife). The statement recorded under Section 161 in paragraph nos. 40, 41, 42 and 43 of the supplementary case

Patna High Court CR. MISC. No.30745 of 2024(4) dt.10-01-2025 2/3 diary reveals that the relatives of the petitioner have stated before the police that the wife of the petitioner has died during her treatment. Learned counsel for the petitioner clearly submitted that the wife of the petitioner had disappeared from the house of the petitioner and the F.I.R. was lodged after seven days. All the circumstances shows that the wife of the petitioner died in the house of the petitioner. After the information of death of his daughter when the informant reached her in-laws house, the door of the house was locked and her in-laws family members had disappeared and they had also disposed of her dead body somewhere else. Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case, coupled with the fact that the petitioner is the husband of the deceased and she died in her matrimonial home, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the prayer of the petitioner for
