66/72 ORAL ORDER 24-07-2026 Heard the parties.

2. The present contempt petition has been filed for non-compliance of the order dated 11.08.2016 passed in C.W.J.C. No. 3460 of 2016 and on account of the observations made and liberty granted by the Hon'ble Supreme Court of India in Civil Appeal No. 7351 of 2021 and its analogues cases.

The learned counsel appearing on behalf of the petitioners submits that Civil Appeal No. 7351 of 2021, which was filed by the State of Bihar for modification of order dated 11.08.2015, the Hon'ble Supreme Court of India was pleased to observe that 'in the light of this, the course that this Court must adopt is, since the matter is a live issue, even from the point of view of the averments seeking modification, the matter must receive the attention of the High Court in the light of the order passed by this Court on 26.02.2016'. It was further observed that 'as noted already, certain petitions at the hands of Unions have attained finality. Matter, which have attained finality cannot be reopened. At the same time, if there are persons who fall within the four walls of the order dated 26.02.2016 they may be entitled to relief as envisaged.' Accordingly, the appeal was allowed and the impugned order was set aside. It was directed that the matter will be considered by the High Court in

67/72 the light of the observations made by the Hon'ble Supreme Court of India and with specific reference to the order dated 26.02.2016. It was further observed that we make it clear that the matters which have become final cannot be reopened.

Since, several intervention applications for impleadment/intervention were filed in the said Civil Appeal No. 7351 of 2021, the Hon'ble Supreme Court of India observed that as far as the applications for impleadment/intervention are concerned, which are many in number, the applicants who wish to withdraw their applications for impleadment with liberty to adopt such remedies as are available to them, such applications will stand dismissed as withdrawn with liberty to seek remedy before the High Court.

5. It is the case of the petitioners that in terms of the liberty granted by the Hon'ble Supreme Court of India, they also withdrew their Intervention Petition no. 182376 of 2019 and 198655 of 2019. It was clarified by the Hon'ble Supreme Court of India that even with respect to such petitions that they cannot get any relief except as is provided to them under the order dated 26.02.2016. Any other application, (where they have not sought to withdraw applications for impleadment/intervention) will stand disposed of without

68/72 prejudice to their right to seek relief if are entitled to relief within the meaning of order dated 26.02.2016.

6. The learned counsel for the petitioners submits that in terms of the liberty granted by the Hon'ble Supreme Court of India, they have preferred the present contempt petition.

The Contempt Petition has been heard on different dates by different Co-ordinate Benches of this Hon'ble Court and the State opposite parties were directed to file their affidavits/supplementary affidavits and finally vide order dated 17.04.2026, this Court granted time to the State opposite parties to respond to the supplementary affidavit filed on behalf of the petitioners on 21.11.2025. In compliance of the order dated 17.04.2026, the State opposite parties have filed a supplementary show cause on 07.05.2026, wherein it has been stated that the Hon'ble Division Bench of this Court vide order dated 22.08.2019 passed in MJC No. 4208 of 2016 (arising out of the same order, from which the present contempt petition has arisen) was pleased to dispose of the contempt petition with certain directions and it was lastly observed that we agree with the statement and reason shown by the State respondents for not absorbing the members of the petitioners' association/Mahasangh. The other petitioners, who were parties

69/72 in their individual name in the writ petition would only qualify for consideration and therefore the State respondents shall consider their cases in similar manner as have been done in respect of Category-I cases. It has further been stated in the supplementary show cause that the petitioners were members of the Union in question, who filed the contempt petition bearing MJC No. 4208/2016, however their names were not disclosed by the Union in the connected writ application, hence in terms of order dated 22.08.2019 passed by the Hon'ble Division bench of this Court, the contempt petition is not made out.

It has further been submitted that only those persons (instructors associated with the non-formal education programme) can be considered for regularization/appointment who has filed a writ application in their individual names before 26.02.2016. Since, the Hon'ble Supreme Court of India in its order dated 26.02.2016 had categorically stated that no individual can claim regularization/appointment on the basis of being a member of a Union, whose names were not disclosed by the Union in the writ application either before this Hon'ble Court or before the Hon'ble Supreme Court of India before 26.02.2016.

70/72 26.02.2016, which is condition precedent for considering their cases. It has further been submitted that names of none of the petitioners, who are petitioners in the present contempt petition i.e. total 1388 or members of the Union have been disclosed prior to 26.02.2016, therefore they do not fulfill the mandatory condition of approaching the Hon'ble Court before 26.02.2016, fixed by the Hon'ble Supreme Court of India. It has further been submitted that the present contempt petition is not maintainable in view of the directions given by the Hon'ble Supreme Court of India and the Hon'ble Division Bench of this Court. It has further been stated that so far the documents, which have been annexed as Annexure-P/2 to the supplementary affidavit are concerned, the department vide its memo no. 798 dated 25.08.

2025 has returned the folder submitted vide letter no. 153 dated 05.08.2025 with a specific query to explain the conduct of sending the folder, which is against the department direction. In the said letter, it has been stated that in view of order dated 22.08.2019 passed in M.J.C. No. 54 of 2013, documents were directed to be produced before the petitioners before 09.10.2019 and the same was published in the newspaper, and therefore the documents related to the petitioners were returned by the department.

The learned counsel for the petitioners submits that the petitioners were actively pursuing their cases before this Hon'ble Court before the prescribed cut of date i.e. 26.02.2016 and they are covered within the four corners of the order dated 26.02.2016 passed by the Hon'ble Supreme Court of India. The present contempt petition has been filed in terms of the liberty granted by the Hon'ble Supreme Court of India vide order dated 02.12.2021 and in terms of the said directions, the petitioners submitted a detailed representation on 15.12.2021, however no response was received, therefore the present contempt petition has been filed.

Having heard the rival submissions and after going through the records, it appears that the petitioners are said to have filed intervention petition before the Hon'ble Supreme Court of India bearing I.A. No. 182376 of 2019 and 198655 of 2019 however, the same was withdrawn with a liberty to take recourse available in law before this Hon'ble Court. From the pleadings made in the present contempt petition as well as the documents, which are available on record and from perusal of the orders passed by the Hon'ble Supreme Court of India as well as this Hon'ble Court, including the order passed by the Hon'ble Division Bench of this Court, this Court is of the

72/72 considered opinion that no contempt is made out to proceed in the matter and accordingly, the present contempt petition stands dismissed.
