The petitioners seek anticipatory bail in a case instituted for the offences under Sections 420 and 414 of the Indian Penal Code and Section 40 of the Bihar Minor Mineral Concession Rules, 1972.

It has been alleged that the tractor loaded with sand was seized.

Learned counsel for the petitioner submits that the petitioner was carrying the load with valid Challan itself apparent from the First Information Report.

Looking to the facts and circumstances of the case, in the

Patna High Court Cr.Misc. No.30434 of 2018 (2) dt.18-05-2018 event of arrest or surrender within four weeks from today, let petitioners, namely, Ravi Singh alias Ravi Kumar Singh and Chandan Kumar Singh, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No.92 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for investigation or interrogation they will present themselves before the police. In the event of being absent on two consecutive dates this order will be treated to have been withdrawn.
