The petitioner apprehends his arrest in connection with Sonepur P.S. Case No.343 of 2017 registered under Sections 302/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Saran at Chapra. The accusation is that 15 persons, named in the F.I.R., including the petitioner having lathi, rod, sword, farsa, axe and other weapons in their hands came near Raj Kapoor Rai, the son of the informant, and assaulted him. While the son of the informant was rushed to Sonepur Referral Hospital for treatment but he died in course of treatment.

No.29099 of 2018(2) dt.10-05-2018 2/2 Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. along with 14 others but no specific overt act is attributed to him. Moreover, the petitioner is aged about 75 years old. Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
