JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-07-2023 The short prayer made by the petitioner in the present writ petition is to direct the Circle Officer, Kuchaikot, District-Gopalganj to dispose of the pending encroachment proceeding bearing Encroachment Case No. 37 of 2022-23.

The learned counsel for the respondentState submits that in case the aforesaid encroachment proceedings are still pending, the same would be taken to its logical conclusion

Patna High Court CWJC No.7653 of 2023(2) dt.12-07-2023 2/2 within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle Officer, Khuchaikot, DistrictGopalganj to dispose of the aforesaid encroachment proceeding, if not already disposed of, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the afected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order. The writ petition stands disposed of on the aforesaid terms.
