JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2018 The petitioner is apprehending his arrest in connection with Gardanibagh P.S. Case No. 223 of 2016, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.
Allegation against the petitioner that he took Rs. 2,00,000/- from the informant as a loan and not returning the same.
It has been submitted on behalf of the petitioner that the petitioner admits that he has taken Rs. 2,00,000/- from the informant on the pretext of marriage of her sister and he is ready to return the said amount, if some reasonable time is given. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.27461 of 2018 (2) dt.10-05-2018 2/2 circumstances of the case and the submission of learned counsel for the petitioner, let the petitioner surrender before the court below with a bank draft of Rs. 50,000/- (Rs. Fifty Thousand) drawn in favour of the informant within a period of six weeks from the date of receipt/production of a copy of this order and the court below after verifying the same shall release the petitioner on provisional bail for a period of six months to his own satisfaction, during which period, the petitioner shall pay the remaining amount of Rs. 1,50,000/- in six equal installments of Rs. 25,000/- in the first week of each month through bank draft drawn in favour of the informant and only after payment of complete amount of Rs. 2,00,000 /-, the bail bonds of the petitioner shall be confirmed by the court below and if the petitioner fails to deposit any of the installments, bail bonds of the petitioner shall be cancelled. The above amount deposited shall be released in favour of the informant.
