JUSTICE SANJAY PRIYA ORAL ORDER 3/ 16-02-2017 Heard Mr. Kumar Samarjeet Singh, learned counsel for the Petitioners and the State.

The Petitioners apprehend their arrest in Mahua P.S. Case No.375 of 2015 instituted for the offence under Section(s) 147, 148, 149, 353, 323, 332, 333, 307, 342, 337, 338, 435 Indian Penal Code and Section 3⁄4 of the Essential Services Maintenance Act.

It has been submitted that there is general and omnibus allegation against the petitioners. Other co-accused have been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 30.11.2015 passed in Cr. Misc. No.54227 of 2015.

From the written report, it appears that on account of death of a person the mob had blocked the road and when the

Patna High Court Cr.Misc. No.53386 of 2016 (3) dt.16-02-2017 2/2 police party arrived there the mob caused obstruction to the police party in discharge of his official duty. From the written report itself, it appears that there is general and omnibus allegation against the petitioners, who have clean antecedents.

In such circumstances, it is ordered that in the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Mahua P.S. Case No.375 of 2015, they shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) Cr. P. C.
