JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This is an application for grant of anticipatory bail in connection with Matihani P.S. Case No. 113 of 2017, disclosing offences under Sections 326, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of taking the son of the informant and assaulted him causing his death. Submission of learned counsel for the petitioner is that so far this petitioner is concerned, police after investigation has not found the case true against him, however cognizance has been taken.

Heard learned A.P.P. also, who drawing my attention towards paras 22, 24 and other paragraphs of the case diary and submitted that name of the petitioner also transpired as the person, who has taken the deceased and thereafter killed the

Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he may move for regular bail, which will be considered on its own merit. Accordingly, this application is dismissed.
