Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Sections 376-AB of the Indian Penal Code and Section 6 of POCSO Act 2012.

Allegation against the petitioner is that he forcibly committed rape upon the victim.

Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case only on the basis of suspicion. Petitioner is in custody since 14.03.2022.

Patna High Court CR. MISC. No.28656 of 2022(2) dt.24-08-2022 2/2 Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that the allegation as alleged in the FIR is very serious and heinous in nature.

Considering the nature of allegation as well as gravity of offence, I am not inclined to enlarge the petitioner on bail in connection with Sheohar Mahila P.S. Case No.09 of 2022 pending in the court of learned Additional Sessions Judge 1st -cum-Special Judge, POCSO, Sheohar.

Prayer is refused.
